Occupational Health Doctor is NOT AN OCCUPATIONAL HEALTH SPECIALIST UNLESS stated as Occupational Health Physician (Field specialization in Occupational Health) by the Public Health Department, Office of the Deputy Director General of Health (Public Health), Ministry of Health Malaysia according to Order 27, Chapter F, General Orders for Medical Officer appointment as Specialist.

OHD can collect the certificate personally from JKKP head quarters or any JKKP state offices.

i. Found to have misconduct, malpractice or negligence with respect to medical ethics or has been blacklisted by Malaysian Medical Council.
ii. Has been convicted of an offence under the Act and regulations made under.
iii.
Providing DOSH, Employer or factory with fraud or false documents / information (OHD shall have legal action if found guilty of providing fraud documents/information).
iv. Providing incomplete documents/information.
v.
Forcing or suggesting the factory/employer to do unnecessary test just to make money (Found to have conflict of interest).
vi.
Unable to justify concrete reasons for unnecessary tests done outside the medical surveillance guidelines (Concrete reasons must be from reference textbooks and reliable Occupational/Environmental Health Journals).
vii.
He has failed to perform his duties as an OHD under USECHH 2000 Regulations and Medical Surveillance Guidelines.
viii.
He refuses to work with other officers of DOSH (Ministry of Human resources) wherever needed.
ix. Found not active with Occupational Safety and Health activities.
x. Resigned as a Medical Practitioner.
xi. Failed during interview session with JKKP officers.
xii. Found not qualified to be registered as an OHD.
xiii. Under specific circumstances and reasons, confined to the Director General Orders.
xiv.
Death.

The notifiable occupational poisoning and occupational disease to DOSH are given by a list under Third Schedule (Occupational Poisoning And Occupational Disease), Occupational Safety And Health (Notification Of Accident, Dangerous Occurrence, Occupational Poisoning And Occupational Disease) Regulations 2004. Notification of occupational poisoning or occupational disease is done by filling the JKKP 7 Form (Report For Occupational Poisoning/Occupational Disease) and sending it to the nearest DOSH State/Branch office. This form is available at the link below:-

The employer of a worker or every registered medical practitioner or medical officer attending to, or called in to visit a patient whom he believes to be suffering from an occupational poisoning or occupational disease should notify the said occupational poisoning or occupational disease to DOSH.

 

The notification requirements of occupational poisoning or occupational disease shall apply to the industries specified in the First Schedule, Occupational Safety and Health Act 1994 (OSHA 1994) as listed below:-

  1. Manufacturing
  2. Mining and Quarrying
  3. Construction
  4. Agriculture, Forestry and Fishing
  5. Utilities (Electricity, Gas, Water and Sanitary Services)
  6. Transport, Storage and Communication
  7. Wholesale and Retail Trades
  8. Hotels and Restaurants
  9. Finance, Insurance, Real Estate and Business Services
  10. Public Services and Statutory Authorities

An occupational poisoning or occupational disease should be notified to the nearest DOSH state/branch office within 7 days (seven days means seven calendar days, including any holidays that fall within that seven days).

The general decision making process consists of five steps:

Step 1: To determine whether a case occurred, that is, whether there was death, dangerous occurrence, poisoning, disease, or an injury.

Step 2: To establish that the case was work related, that it resulted from an event or exposure in the work environment.

Step 3: To decide whether the case is an accident, dangerous occurrence or an occupational poisoning or occupational disease.

Step 4: And if the case is an occupational poisoning or occupational disease, notify using JKKP 7 form, record and check the appropriate occupational poisoning or occupational disease category on the JKKP 8 Form.

Step 5: Or if the case is death, serious bodily injury or dangerous occurrence, notify the case immediately by the quickest means, then send a written report using JKKP 6 Form within seven days and together with other case record in the JKKP 8 Form.

The noise related hearing diseases/disorders are regulated under the Occupational Safety and Health (Notification of Accident, Dangerous Occurrence, Occupational Poisoning and Occupational Disease) Regulations 2004 and the Factory and Machinery (Noise Exposure) Regulations1989. For this purpose, a noise-induced hearing loss (NIHL), hearing impairment, permanent standard threshold shift, and acoustic trauma arising from noise exposure at workplace should be notified to the nearest DOSH state office.

The necessary forms to fill up are:

USECHH 1- To be given to the employer and a copy to be kept by the Occupational Health Doctor (OHD).

USECHH 2- To be given to the employer.

USECHH 3- To be given to the employer.

USECHH 4- To be given to the employer and a copy to be sent to Occupational Health Division, DOSH Putrajaya.

USECHH 5i and 5ii - If there are any abnormal results pertaining to the medical surveillance conducted, the OHD should submit a copy along with the USECHH 4.

The department does not dictate fees for Medical Surveillance. It is purely based on market demands. It would be best to confer with other practising OHD'S on how they charge their clients in regards to Medical Surveillance conducted. The other option would be to follow the Guidelines by MMA on
