Court Resort fined for failing to report accident immediately

KOTA KINABALU: A Magistrate’s Court here yesterday fined a resort RM5,000, in default, one month’s jail for failing to send a report of the death of its worker immediately to the Department of Occupational Safety and Health (DOSH).

Magistrate Ryan Saginraan Rayner Jr imposed the fine on the resort, which was represented by its safety and security manager.

The resort had failed to immediately inform the nearest DOSH’s office about an accident involving a 28-year-old local man who was electrocuted at the kitchen of the resort off Jalan Sepanggar on May 3.

The offence was framed under Regulation 13 of the Occupational Safety and Health (Notification of Accident, Dangerous Occurrence, Occupational Poisoning and Occupational Diseases) Regulations 2004 which carries a maximum fine of RM10,000 or a jail term of up to one year, or both, upon conviction.
